Terms and Conditions for the Supply of Goods through the website you are connected to the User Agreement for Sheenashona Limited, registered address, 5 Montgomery Place, Irvine, Ayrshire, Scotland, GB, KA12 8PN. This service is operated by Sheenashona Ltd (Sheenashona Ltd and Sheenashonajewellery.com each separately and together in this Agreement, “we”, “us” or “our”).
1. The Contract between you and us
In these Conditions of Sale “Seller” shall mean Sheenashona Limited and/or its successors, assignees, sub-contractors and agents; “Buyer” shall mean any person or persons, firm or firms, company or companies, authority or authorities who shall order or buy the Goods and shall include his or their successors, executors and personal representatives: “Goods” shall mean the equipment, goods and/or materials supplied or sold by the Seller in terms of any individual Contract (including all replacements and renewals thereof and all accessories and additions thereto whether added or made before or after the date of the relative order); “Contract” shall mean any contract for the sale or supply of the goods by the Seller to the Buyer; “Conditions of Sale” shall mean the terms and conditions of sale set out herein.
No quotation, advertisement or issue of a catalogue by the Seller shall constitute an offer. We must receive payment in whole for the price of the goods that you order before your order can be accepted. No previous correspondence, writings, telexes, facsimile, telegrams or verbal communications between the Buyer and the Seller regarding the goods shall form part of or be incorporated into the contract. Once payment has been received by us we will confirm that your order has been received by sending an email to you at the email address you provided during the order/checkout process. This is not an Order Acceptance from Sheenashona. Our acceptance of your order takes place on the despatch to you of the products ordered unless we notify you that we do not accept your order, or you have cancelled your order in accordance with clause 5. Our acceptance of your order brings into existence a legally binding contract between us. Only adults (persons aged 18 and over) are entitled to enter into legally binding contracts and as a result are the only people entitled to transact through this site. Any other individuals who are unable to perform legally binding contracts are prohibited from ordering goods using this site. If you do not qualify do not use this site.
2. Pricing, Delivery, Discount Codes & Offers
2.1 The prices payable for goods that you order are as set out in our website.
2.1.1 All of our prices are in UK Pounds Sterling. You will be billed in UK Pounds sterling and if you purchase from outside the UK, currency fluctuations and credit card charges may make a difference to the amount billed on your credit card.
2.1.2 If you purchase a diamond ring and it needs re-sized there will be no cost for the initial re-sizing. Any additional size adjustment to the same ring will be charged at £40.00.
2.2 You may be required to pay extra for delivery and it might not be possible for us to deliver to some locations. Our delivery charges are set out in our website.
2.3 Promotional discount codes: We may from time to time offer promotional discount codes (either directly or via third parties) which may apply to all or certain specified products purchased via this Website. Such codes may only be applied to full-price items and exclude all delivery charges. Discount codes cannot be used in conjunction with any other offer or sale items. Where Sheenashona have a limited offer running such as 'receive a free gift over a certain spend value' we reserve the right to substitute different designs and products to a similar value depending on stock availability levels.

2.5 Notice of Damage and Non-Delivery must be notified to the Seller at firstname.lastname@example.org within seven days of invoice, failing which the Seller shall be under no liability for non-delivery.
3 Gift Vouchers
3.1 Gift Vouchers should be treated like cash but will not be exchanged for cash.
3.2 Gift Vouchers cannot be replaced if lost or stolen and cannot be used as a deposit on item(s).
3.3 Gift Vouchers must be of redeemed within one year of the purchase date and may only be redeemed at www.sheenashonajewellery.com. When redeeming Gift Vouchers change will be given in Gift Vouchers except where the amount due is below £5.00.
3.4 When a Gift Voucher is purchased you will receive the Gift Voucher electronically by email to the delivery email(s) specified.
3.5 Risk will pass to the customer upon delivery to the specified email address.
3.6 Gift Voucher amounts should be checked immediately upon receipt. Any discrepancies must be notified immediately to Sheenashona Limited at email@example.com
4. Right for you to cancel your contract or change your order
4.1 Subject to 4.3 below, you may cancel your contract with us for the goods you order at any time within 14 days of the date of shipment. You do not need to give us any reason for cancelling your contract nor will you have to pay any penalty but you will have to pay the return shipping costs if the goods have been dispatched.

4.3 Your right to cancel your contract with us for the goods you have ordered is subject to:
a) You not having worn or damaged the jewellery or used the candles, tealights, wedding favours and/or diffusers (they must be returned in a re-saleable condition)
b) You not having removed any security tags from the item.
c) You calling us within 14 days of the date of shipment and receiving a ‘Returns Authorisation number’. Once you have received a Returns authorisation number you have up to 7 days in which to return the goods including the orginial boxes in which the jewellery, candles, diffuser, tealights and or gifts were sent in. If you have received a free gift as part of any offer or jewellery purchase this item must be included in your return parcel. 4.4 If any of the items purchased are bespoke or have been personalised and/or engraved (for example with your initials or name) they cannot be exchanged or returned under any circumstances. In the interests of hygiene we will not accept the return of earrings under any circumstances.
4.5 Once you have notified us that you are cancelling your contract, any sum debited from your credit card will be credited to your account as soon as possible and in any event within 14 days of your order provided that the goods in question are returned by you and received by us in the condition they were in when delivered to you along with a valid receipt. We do not pay for the return shipping costs. If you do not return the goods delivered to you, in the way detailed above, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be credited to you.
4.6 If you wish to change your order you are able to do so as long as the items have not been dispatched and is not a personalised/engraved product. Please note we generally process & prepare orders for dispatch quickly. If your order has already been picked up/dispatches with our courier you will be unable to change your order and in that circumstance you will have to follow the returns process.
5. Cancellation by us
5.1 We reserve the right to cancel the contract between you and us if:
5.1.1 we have insufficient stock to deliver the goods you have ordered;
5.1.2 we do not deliver to your area/country; or
5.1.3 one or more of the items you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
5.2 If we do cancel your contract we will notify you by email or by telephone, and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 14 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.
6. Delivery & Return of goods
6.1 We will deliver the goods ordered by you to the address you have given us for delivery at the time you make your order. It is your responsibility to ensure that the delivery address you give us is correct and accurate and that there is somebody to sign for and take delivery of the goods from the delivery service used.
6.2 UK & International orders are shipped by Royal Mail but may also be delivered by other couriers.
Delivery Charges: Royal Mail mainland UK delivery is free with a delivery window of 2-3 working days, Royal Mail next day delivery is charged at £7.50. Standard delivery for Highlands & Islands, Isle of Man, Isles of Scilly and Northern Ireland is free with Royal Mail standard delivery with a delivery window of 2-3 working days. Saturday Delivery for all orders placed and payment cleared before 2pm on Friday excluding bank holidays within the UK mainland may be dispatched using our Saturday Royal Mail Special Delivery which is charged at £10.50. Please be aware that Royal Mail Delivery for Next Day UK is 2 working days for Highlands & Islands, Isle of Man, Isles of Scilly and Northern Ireland is available for items ordered and where payment has cleared before 2pm that day Monday to Friday.
* Deliveries within the European Union will take up to 3-5 working days and are charged at £9.95 inclusive of VAT. Europe -non EU delivery will take 3-5 working days and is charged at £9.95 exclusive of VAT with the exception or Russia, Armenia, Azerbaijan Kazakhstan, Kyrgyzstan, Tajikistan, Turkmenistan Uzbekistan and Georgia which will be charged at £10.79 exclusive of VAT.
* America, Canada & Mexico and the Rest of the World, International Delivery will take 5-7 working days and is charged at £12.46 exclusive of VAT
* All duty and taxes incurred in the country of destination are the responsibility of the customer. We also ask that you allow up to 10 working days subject to customs procedures or any delays in countries out with the EU. Please click here to view full delivery charge details. Non EU orders for both goods & delivery are exclusive of VAT. VAT (20%) is removed from your order during the checkout process.
6.3 You will become the owner of the goods you have ordered when they have been dispatched to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.
6.4 We make no promise that materials on our website are appropriate or available for use in locations outside the United Kingdom, and accessing the website from territories where its contents are illegal or unlawful is prohibited. If you choose to access this site from locations outside the United Kingdom, you do so, on your own initiative and are responsible for compliance with local laws.
6.5 If your order is returned to us because the courier or postal service could not complete the delivery to you for whatever reason, then you will be responsible for the repeat delivery costs. In the case where your parcel is being carried by our main carrier UPS they will attempt to deliver up to and inclusive to a maximum of three times before returning the parcel to ourselves..
6.6 Please click here to view full delivery charge details. Please note we do not refund the original delivery charge or pay for the return delivery charge unless the goods are faulty or have been incorrectly supplied. In such circumstances we may arrange collection via our UPS courier.
6.7 Should you wish to return the good please see our returns policy. All items returned will be at the cost of the customer. All international customs duties and sales taxes are NOT refunded for shipments outside the European Community (EU)
7.1 If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us by email of the problem within 7 days of the date of shipment.
7.2 If you do not receive goods ordered by you within 7 working days of the date on which you ordered them, we shall have no liability to you unless you notify us by email or telephone at our contact address of the problem. If you notify us of a problem under this condition, our only obligation will be, at your option either:
7.2.1 to make good any shortage or non-delivery; or
7.2.2 to replace any goods that are damaged or defective; or
7.2.3 to refund to you the amount paid by you for the goods in question in whatever way we choose.
7.3 Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify us of under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under clause 7.2.3 above.
7.4 You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.
7.5 Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
7.6 We cannot be held responsible for any delays once the goods have left us and are in possession of Royal Mail, UPS or any other courier we choose to use. We have no liability to pay any money to you in the way of compensation for the delay of goods due to a courier service other than to refund you the amount paid by you for the goods in question under clause 7.2.3. Where goods are in transit and may be delayed we will work with the appropriate courier to locate the item(s) and ascertain the issue. We have no obligation to replace or dispatched any additional goods until this procedure has been carried out and the item(s) located.
8. Events Beyond our Control/ Force Majeure
The Seller shall not be liable for any loss or damage caused by the delay in the performance of any of its obligations hereunder where the same is occasioned by any cause whatsoever that is beyond the Seller’s control including but not limited to an Act of God, war, civil disturbance, requisitioning, governmental or parliamentary restrictions, prohibitions or enactments of any kind; import or export regulations, strike, lock-out or trade dispute (whether involving its own employees or those of any other person), breakdown of machinery, fire or accident. Should any such event occur the Seller may cancel or suspend the contract without incurring any liability for any loss or damage thereby occasioned
Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent by email to our contact address at firstname.lastname@example.org and from us to you will be displayed on our website from time to time.
If any part of these terms and conditions is unenforceable (including any provision in which we exclude we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.
11.2. Your Account, if you use the website, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer to prevent unauthorised access to your account. You agree to accept responsibility for all activities that occur under your account or password. No permission is given by us in respect of the use of any such brand names, photographs, product names or titles or copyrights and such use may constitute an infringement of the owners’ rights.
15. Ruling Law
Each and every transaction carried out is deemed to be completed within the United Kingdom and therefore shall be governed by and interpreted in accordance with Scots Law. The terms of this charter (and any dispute, controversy, proceedings or claims of whatever nature in relation to them) shall be governed and interpreted in accordance with Scots Law and the Scottish Courts shall have exclusive jurisdiction in relation thereto.
17. Financial Transactions & Fraud
To process your order we need your credit card number and expiry date, plus any security details that the credit card processor may require. This process takes place in a secure environment. We use World pay “secure payment services” to process your payments meeting all requirements issued by consumer protection and law.
We regularly review the security of the system and follow the strict instructions of World pay. We also provide your name, address and email contact information to our delivery courier Royal Mail and UPS to enable them to provide you a unique tracking number via email to track the status of your delivery. At all times we endeavour to ensure that all financial transactions processed have the highest possible risk management procedures and processes in place. Here at Sheenashona Jewellery we have implemented a risk management package with our payment gateway to help protect you our valued customers and our business. In addition to electronic risk management procedures in certain circumstances we may also undertake additional checks before dispatching an order. It is therefore very important to ensure that any information supplied to us is 100% accurate. In the case of any potential fraudulent behaviour our company policy is clear - we will in all cases cooperate to the fullest extent with the appropriate policing authority and in such circumstance should they ever arise as a business will always prosecute.

Time to time Sheenashona will run promotions when you spend over a certain amount you will receive a free gift. If any item from the order is returned and the value of the order falls below the stated value required to receive a free gift then the free gift will need to be returned. If the free gift is not returned then we reserve the right to redeem the RRP price against your refund.

Entry is open to residents of the United Kingdom of Great Britain & Northern Ireland (NI) who are aged 18 years or over. Employees of Sheenashona Ltd and any associated group companies, prize sponsor and/or agencies associated with our competitions and their immediate families are ineligible to enter. Any such entries will be invalid. For these purposes, immediate family includes partner, grandchild, child, brother, step-brother, sister, step-sister, parent, step-parent, or grandparent of you or your partner or anyone noted as next of kin on any legal document. Sheenashona reserves the right to require proof of age and evidence to verify the identity of an entrant at any time, and may use any reasonable channels and methods available to carry out checks of any details provided by entrants.
The closing date of the competition will be clearly stated. The prize will be drawn from entries receive who have completed their name, email and contact telephone number and have liked us on facebook. Any entries received after the date stated will be disregarded. By entering the competition you are accepting that you will be added to our mail list.

Any entries which are incomplete, incorrect, incomprehensible, or not received by Sheenashona by the due date will be void. Sheenashona will not be liable to reimburse expenses incurred in making an entry. Only one entry per person is allowed.
Only one prize will be given to one person. On winning you will be contacted and your prize can be picked up from our Glasgow Store or may be sent to you at the discretion of Sheenashona as long as you live within The UK or Northern Ireland. The prize is as specified in the competition information. The winner is solely responsible for all insurance, applicable taxes and for any costs, expenses and charges not included in the prize description in the competition information. The prize is also subject to any terms and conditions of the manufacturer or supplier. The winner is randomly selected from all the correct and valid entries on the date given.
The winner will be notified on the date the winning entry is selected or as soon as practical thereafter, or as otherwise indicated in the Competition Information by email. You will have a 20 working days in which to claim your prize. Failure to respond within the specified time period may result in forfeiture of the prize although Sheenashona will make reasonable efforts to contact the winner to ensure this does not happen. However, Sheenashona reserves the right to offer the prize to the next eligible entrant and thereafter until a winner is found.
Sheenashona may refuse to provide a prize, or may seek its recovery, in the event of non-entitlement under these terms or an entrant's breach of these terms, or the competition information, or fraud or dishonesty. Sheenashona reserves the right in its sole discretion to withhold delivery of a prize until proof of eligibility and identity has been confirmed and to disqualify the entrant in the event this is not provided, within any period specified by Sheenashona. Sheenashona endeavours to deliver the prize to the winner within twenty eight (28) days from the date of the claim. No cash equivalent or alternative prize will be given and the prize is non-transferable and non-exchangeable. However, Sheenashona reserves the right to change the prize due to circumstances beyond its control or to offer an alternative of similar value.
Nothing in these terms and conditions restricts your statutory rights as a consumer. For more details on your statutory rights you should contact your local Trading Standards Office or Citizen's Advice Bureau. Sheenashona excludes liability for any fault, malfunction, damage, loss or disappointment suffered by any entrant howsoever arising from participating in any competition whether due to any error, omission or other cause by Sheenashona , its employees, agents or others to the fullest extent permitted by law. In particular, Sheenashona is not responsible for any damage or loss caused to an entrant where such damage or loss is not reasonably foreseeable including where the damage or loss results from Sheenashona breach of these terms and conditions. Sheenashona does not accept liability for any damage or loss caused to you where you are not entering into a competition as a consumer. Sheenashona cannot promise that the various processes involved in providing the competition will be free from errors or omissions nor that they will be available uninterrupted and in a fully operating condition at all times. These services may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons reasonably beyond the control of Sheenashona. Sheenashona will not be liable to you or to any other person in the event that all or any part of these services are discontinued, modified or changed in any way.
In the event that any entrant does not, or is unable to comply with these terms and conditions or the competition information, Sheenashona shall be entitled at its sole discretion to disqualify such entrant, without any further liability to such entrant. Entrants must comply with any directions given to them by Sheenashona including in relation to any and all relevant laws, rules and regulations. These terms and conditions are available in English only and shall be exclusively governed by and construed in accordance with the laws of Scotland.
